It is a matter of fact that Europe is facing more and more crucial challenges regarding health and social care due to the demographic change and the current economic context. The recent COVID-19 pandemic has stressed this situation even further, thus highlighting the need for taking action. Active and Assisted Living technologies come as a viable approach to help facing these challenges, thanks to the high potential they have in enabling remote care and support. Broadly speaking, AAL can be referred (...) to as the use of innovative and advanced Information and Communication Technologies to create supportive, inclusive and empowering applications and environments that enable older, impaired or frail people to live independently and stay active longer in society. AAL capitalizes on the growing pervasiveness and effectiveness of sensing and computing facilities to supply the persons in need with smart assistance, by responding to their necessities of autonomy, independence, comfort, security and safety. The application scenarios addressed by AAL are complex, due to the inherent heterogeneity of the end-user population, their living arrangements, and their physical conditions or impairment. Despite aiming at diverse goals, AAL systems should share some common characteristics. They are designed to provide support in daily life in an invisible, unobtrusive and user-friendly manner. Moreover, they are conceived to be intelligent, to be able to learn and adapt to the requirements and requests of the assisted people, and to synchronise with their specific needs. Nevertheless, to ensure the uptake of AAL in society, potential users must be willing to use AAL applications and to integrate them in their daily environments and lives. In this respect, video- and audio-based AAL applications have several advantages, in terms of unobtrusiveness and information richness. Indeed, cameras and microphones are far less obtrusive with respect to the hindrance other wearable sensors may cause to one’s activities. In addition, a single camera placed in a room can record most of the activities performed in the room, thus replacing many other non-visual sensors. Currently, video-based applications are effective in recognising and monitoring the activities, the movements, and the overall conditions of the assisted individuals as well as to assess their vital parameters. Similarly, audio sensors have the potential to become one of the most important modalities for interaction with AAL systems, as they can have a large range of sensing, do not require physical presence at a particular location and are physically intangible. Moreover, relevant information about individuals’ activities and health status can derive from processing audio signals. Nevertheless, as the other side of the coin, cameras and microphones are often perceived as the most intrusive technologies from the viewpoint of the privacy of the monitored individuals. This is due to the richness of the information these technologies convey and the intimate setting where they may be deployed. Solutions able to ensure privacy preservation by context and by design, as well as to ensure high legal and ethical standards are in high demand. After the review of the current state of play and the discussion in GoodBrother, we may claim that the first solutions in this direction are starting to appear in the literature. A multidisciplinary debate among experts and stakeholders is paving the way towards AAL ensuring ergonomics, usability, acceptance and privacy preservation. The DIANA, PAAL, and VisuAAL projects are examples of this fresh approach. This report provides the reader with a review of the most recent advances in audio- and video-based monitoring technologies for AAL. It has been drafted as a collective effort of WG3 to supply an introduction to AAL, its evolution over time and its main functional and technological underpinnings. In this respect, the report contributes to the field with the outline of a new generation of ethical-aware AAL technologies and a proposal for a novel comprehensive taxonomy of AAL systems and applications. Moreover, the report allows non-technical readers to gather an overview of the main components of an AAL system and how these function and interact with the end-users. The report illustrates the state of the art of the most successful AAL applications and functions based on audio and video data, namely lifelogging and self-monitoring, remote monitoring of vital signs, emotional state recognition, food intake monitoring, activity and behaviour recognition, activity and personal assistance, gesture recognition, fall detection and prevention, mobility assessment and frailty recognition, and cognitive and motor rehabilitation. For these application scenarios, the report illustrates the state of play in terms of scientific advances, available products and research project. The open challenges are also highlighted. The report ends with an overview of the challenges, the hindrances and the opportunities posed by the uptake in real world settings of AAL technologies. In this respect, the report illustrates the current procedural and technological approaches to cope with acceptability, usability and trust in the AAL technology, by surveying strategies and approaches to co-design, to privacy preservation in video and audio data, to transparency and explainability in data processing, and to data transmission and communication. User acceptance and ethical considerations are also debated. Finally, the potentials coming from the silver economy are overviewed. (shrink)

Sacrificial dilemmas such as the trolley problem play an important role in experimental philosophy (x-phi). But it is increasingly argued that, since we are not likely to encounter runaway trolleys in our daily life, the usefulness of such thought experiments for understanding moral judgments in more ecologically valid contexts may be limited. However, similar sacrificial dilemmas are experienced in real life by animal research decision makers. As part of their job, they must make decisions about the suffering, and often the (...) death, of many non-human animals. For this reason, a context-specific investigation of so-called “3R dilemmas” (i.e., dilemmas where there is a conflict between the principles of replacement, reduction, and refinement of the use of animals in research) is essential to improve the situation of both non-human animals and human stakeholders. An approach well suited for such investigation is experimental philosophical bioethics (“bioxphi”), which draws on methods similar to x-phi to probe more realistic, practical scenarios with an eye to informing normative debates and ethical policy. In this article, we argue for a need to investigate 3R dilemmas among professional decision-makers using the tools of bioxphi. In a first step, we define 3R dilemmas and discuss previous investigations of professionals’ attitudes in such cases. In a second step, we show how bioxphi is a promising method to investigate the whys and hows of professional decision-making in 3R dilemmas. In a last step, we provide a bioxphi template for 3R dilemmas, give recommendations on its use, explore the normative relevance of data collected by such means, and discuss important limitations. Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

This chapter aims to examine the configuration of the sharing economy in the United Kingdom. The chapter provides an examination of the key opportunities and challenges that this socio-economic model generates in the country. It includes an account of different sharing economy initiatives in the United Kingdom, including crowdfunding projects, tool libraries, timesharing banks, men’s sheds, and shared workspaces, commercial sharing economy services, micro-libraries, community-gardening projects, and paid online peer-to-peer accommodation. Increased consumer choice and economic benefits derived from an extended (...) economy around the sharing economy are identified as key opportunities. Key challenges relate to policymaking and taxation of businesses and participants in the sharing economy, as well as the wider enforcement of health and safety regulations and the impact that the recent pandemic is having on the industry. The chapter also provides an examination of the latest developments and regulations in this area. In addition, the chapter identifies the most pressing issues and possible future directions of research in this context. (shrink)

Objectives To increase postmortem organ donation rates, several countries are adopting an opt-out (presumed consent) policy, meaning that individuals are deemed donors unless they expressly refused so. Although opt-out countries tend to have higher donation rates, there is no conclusive evidence that this is caused by the policy itself. The main objective of this study is to better assess the direct impact of consent policy defaults per se on deceased organ recovery rates when considering the role of the family in (...) the decision-making process. This study does not take into account any indirect effects of defaults, such as potential psychological and behavioural effects on individuals and their relatives. -/- Design Based on previous work regarding consent policies, we created a conceptual model of the decision-making process for deceased organ recovery that included any scenario that could be directly influenced by opt-in or opt-out policies. We then applied this model to internationally published data of the consent process to determine how frequently policy defaults could apply. -/- Main outcome measures We measure the direct impact that opt-in and opt-out policies have per se on deceased organ recovery. -/- Results Our analysis shows that opt-in and opt-out have strictly identical outcomes in eight out of nine situations. They only differ when neither the deceased nor the family have expressed a preference and defaults therefore apply. The direct impact of consent policy defaults is typically circumscribed to a range of 0%–5% of all opportunities for organ recovery. Our study also shows that the intervention of the family improves organ retrieval under opt-in but hinders it under opt-out. -/- Conclusions This study may warn policy makers that, by emphasising the need to introduce presumed consent to increase organ recovery rates, they might be overestimating the influence of the default and underestimating the power granted to families. Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. Families play an essential role in deceased organ procurement. As the person cannot directly communicate his or her wishes regarding donation, the family is often the only source of information regarding consent or refusal. We provide a systematic description and analysis of the different roles the family can play, and actions the family can take, in the organ procurement process across different jurisdictions and consent systems. First, families can inform or update healthcare professionals about a person’s donation wishes. Second, families (...) can authorize organ procurement in the absence of deceased’s preferences and the default is not to remove organs, and oppose donation where there is no evidence of preference but the default is to presume consent; in both cases, the decision could be based on their own wishes or what they think the deceased would have wanted. Finally, families can overrule the known wishes of the deceased, which can mean preventing donation, or permitting donation when the deceased refused it. We propose a schema of 4 levels on which to map these possible family roles: no role, witness, surrogate, and full decisional authority. We conclude by mapping different jurisdictions onto this schema to provide a more comprehensive understanding of the consent system for organ donation and some important nuances about the role of families. This classificatory model aims to account for the majority of the world’s consent systems. It provides conceptual and methodological guidance that can be useful to researchers, professionals, and policymakers involved in organ procurement. (shrink)

Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. Goal: To assess public knowledge and attitudes towards the family’s role in deceased organ donation in Europe. -/- Methods: A systematic search was conducted in CINHAL, MEDLINE, PAIS Index, Scopus, PsycINFO, and Web of Science on December 15th, 2017. Eligibility criteria were socio-empirical studies conducted in Europe from 2008 to 2017 addressing either knowledge or attitudes by the public towards the consent system, including the involvement of the family in the decision-making process, for post-mortem organ retrieval. Screening and data collection (...) were performed by two or more independent reviewers for each record. -/- Results: Of the 1482 results, 467 studies were assessed in full-text form, and 33 were included in this synthesis. When the deceased has not expressed any preference, a majority of the public support the family's role as a surrogate decision-maker. When the deceased expressly consented, the respondents' answers depend on whether they see themselves as potential donors or as a deceased's next-of-kin. Answers also depend on the relationship between the deceased and the decision-maker(s) within the family, and on their ethnic or cultural background. -/- Conclusions: Public views on the authority of the family in organ donation decision-making require further research. A common conceptual framework and validated well-designed questionnaires are needed for future studies. The findings should be considered in the development of Government policy and guidance regarding the role of families in deceased organ donation. (shrink)

This paper analyses the arguments for and against what we have called automatic organ procurement model in relation to the organs of the deceased. For this purpose, this work provides empirical evidence to assess the potential impact of this model on donation rates and on public opinion. Specifically, we examine first the reasons supporting this model, with special reference to utilitarian and justice arguments. On the other hand, we analyse both the approaches based on the violation of pre mortem and (...) post mortem interests opposing this theoretical model and the rejection the model would generate in the population. Finally, we point out the aspects that, in our opinion, should be exhaustively regulated if this model were implemented. In particular, we refer to the legal status of the human body, the treatments for end-of-life patients, the incentives for health professionals and the recognition of the right to conscientious objection. In this position paper, we have used Alan Cooper’s persona technique to illustrate the utility of audio- and video-based AAL technologies. Therefore, two primary examples of potential audio- and video-based AAL users, Anna and Irakli, serve as reference points for describing salient ethical, legal and social challenges related to use of AAL. These challenges are presented on three levels: individual, societal, and regulatory. For each challenge, a set of policy recommendations is suggested.

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. Perez-Rodriguez and de la Fuente (2017) assume that although human races do not exist in a biological sense (“geneticists and evolutionary biologists generally agree that the division of humans into races/subspecies has no defensible scientific basis,” they exist only as “sociocultural constructions” and because of that maintain an illusory reality, for example, through “racialized” practices in medicine. Agreeing with the main postulates formulated in the article, we believe that the authors treat this problem in a superficial manner and (...) have failed to capture the current state of the field of knowledge in science and the humanities. Esta investigación retoma la obra de Gabriel García Márquez, Noticia de un secuestro (1996), con la volición de cuestionar la idea de Estado nación que está inmersa en el libro. Para ello, es necesario entender que la naturaleza del texto exige un conocimiento amplio al lector o al intérprete, puesto que su contenido revela datos multidisciplinarios. Además, es insoslayable realizar un análisis discursivo de la historia de ese contexto y cotejar con pasajes del mismo libro. Para facilitar esta labor, la (...) extrapolación de conceptos del teórico Luis Rodríguez Manzanera será de utilidad, ya que él despliega definiciones de Criminología, un tema frecuente en la obra. Verbigracia, la macrocriminalidad, una noción que él postula, permite que se comprenda la complexión del periodo histórico finisecular del siglo XX en Colombia, etapa que le corresponde a Noticia de un secuestro. Por otro lado, es menester dilucidar que este estudio no se reduce a lo literario, lo histórico y lo criminológico, sino que abarca distintas disciplinas, por lo que la exigencia en la consolidación epistemológica e interpretativa estará demostrada consuetudinariamente, sin obviar la inmanencia de la obra. Este tipo de análisis interdisciplinarios ya ha sido trabajado desde los Estudios Culturales, tal como se constata en las investigaciones de Richard Johnson (2000) o Néstor García Canclini (1997). De igual modo, el intento de establecer lineamientos y conexiones entre disciplinas como las de Literatura y Derecho ya ha sido desarrollado por Stanley Fish (1986), Faustino Martínez (2005), Carlos Pérez (2006) y Denise Schalet (2014). A diferencia de estos abordajes ya estudiados, el objetivo de esta investigación es detectar y fundamentar cómo se articula una propuesta ideológica desde una configuración que reanuda elementos históricos y literarios. En específico, lo que se busca es argumentar por qué fracasó implícitamente un proyecto sociopolítico de democracia y progreso, a partir de un panorama de violencia, narcoterrorismo, corrupción, negociaciones ilícitas, transgresión a los derechos humanos e inseguridad ciudadana. Con todo ello, esta tesis de maestría terminará siendo fructuosa para análisis postremos de discursos que tienen como esencia un soporte multidisciplinario. (shrink)

Pérez Carballo adopts an epistemic utility theory picture of epistemic norms where epistemic utility functions measure the value of degrees of belief, and rationality consists in maximizing expected epistemic utility. Within this framework he seeks to show that we can make sense of the intuitive idea that some true beliefs—say true beliefs about botany—are more valuable than other true beliefs—say true beliefs about the precise number of plants in North Dakota. To do so, however, Pérez Carballo argues that we must (...) think of the value of epistemic states as consisting in more than simply accuracy. If we want to say what “fundamentality” means, we have to start by approaching what we generally see at the empty place of the predicate “____ is fundamental”. We generally talk about fundamental entities and fundamental theories. At this article, I tried to make a metaphysical approach of what is for something to be fundamental, and I also tried to talk a little bit of fundamental incomplete and complete theories. To do that, I start stating the notion of “entity” and (...) looking at the difference at perceived entities. The difference led us to talk about the entities’ structures and their powers, and about the supervenience between these last two. The supervenience talk made us to see the fight between emergentism and reductionism as the difference between the irreducibility of laws and the reducibility of powers and structures to lower-order domains. Then, we conclude that “fundamentality” is a mereological relation – a relation that a whole structure has to a certain combination of its structural parts or that a power has to a certain combination of its constituent powers – of to be identical and to exist in virtue of them. Consider a certain red rose. The proposition that the rose is red is true because the rose is red. One might say as well that the proposition that the rose is red is made true by the rose’s being red. This, it has been thought, does not commit one to a truthmaker of the proposition that the rose is red. For there is no entity that makes the proposition true. What makes it true is how the rose is, and how (...) the rose is is not an entity over and above the rose. It is against this view that I shall argue in this paper. I shall argue that a significant class of true propositions, including inessential predications like the proposition that the rose is red, are made true by entities. "No truthmaking without truthmakers" is my slogan. Although I have my view about what kinds of entities are truthmakers, I shall not argue for or presuppose that view here. All I shall argue for here is that if a proposition is made true by something, it is made true by some thing, but my argument will leave it open what kind of thing that thing is: it could be a fact or state of affairs, a trope, or any other sort of entity. In “Is Justified True Belief Knowledge?” Edmund Gettier (1963) attacked the thesis ‘S knows that P iff P is true, S believes that P, and S is justified in believing that P’. His intention was to sustain that someone can have a justified true belief without knowing that belief. He made that by creating two counter-examples to that thesis. In this article, I try to show that Gettier’s arguments are based in a weak account of justification, and that such a (...) weak view cannot talk about someone knowing something. En este artículo argumento que, pese al llamado “escepticismo cartesiano”, el significado y alcance de la refutación cartesiana del escéptico y del ateo pueden comprenderse a la luz de tres hitos metafísicos. En la primera sección examino de qué forma este filósofo emplea argumentos escépticos como método, no como fin. Tal como enfatizo, el cogito es el punto en que la duda hiperbólica debe detenerse. Luego, en la segunda sección, discuto por qué Descartes es contrario al fideísmo. Debido a que (...) este se relaciona con el escepticismo, y con la imposibilidad de probar la existencia de Dios, Descartes prueba que Él existe. Sostengo, en la sección final, que Dios es garante de la certeza epistemológica, incluso en el caso de las ideas claras y distintas, cuya confiabilidad pareciera en peligro debido a la hipótesis escéptica del genio maligno. Según el francés, entonces, probar que Dios existe es necesario para garantizar el conocimiento cierto, y es base para inferir la existencia del mundo externo. Los tres hitos, entonces, parecen suficientes para delimitar el sentido y alcance del llamado escepticismo cartesiano. (shrink)

Saul Kripke argued that the requirement that knowledge eliminate all possibilities of error leads to dogmatism . According to this view, the dogmatism puzzle arises because of a requirement on knowledge that is too strong. The paper argues that dogmatism can be avoided even if we hold on to the strong requirement on knowledge. I show how the argument for dogmatism can be blocked and I argue that the only other approach to the puzzle in the literature is mistaken.

1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' And according to common philosophical opinion this means that the Bundle Theory is false.. (shrink)

I propose and defend the conjecture that what explains why Gettiered subjects fail to know is the fact that their justified true belief depends essentially on unknown propositions. The conjecture follows from the plausible principle about inference in general according to which one knows the conclusion of one’s inference only if one knows all the premises it involves essentially.

Descartes maintained substance dualism, the thesis that no substance has both mental and material properties. His main argument for this thesis, the so-called separability argument from the Sixth Meditation (AT VII: 78) has long puzzled readers. In this paper I argue that Descartes’ independence conception of substance (which Descartes presents in article 51 of the Principles) is crucial for the success of the separability argument and that Descartes used this conception of substance to defend his argument for substance dualism from (...) an important objection. En este trabajo examino cómo el Funcionalismo de Máquina de Turing resulta compatible con una forma de dualismo, lo que aleja a la IA clásica o fuerte del materialismo que la inspiró originalmente en el siglo XIX. Para sostener esta tesis, argumento que efectivamente existe una notable cercanía entre el pensamiento cartesiano y dicho funcionalismo, ya que el primero afirma que es concebible/posible separar mente y cuerpo, mientras que el segundo sostiene que no es estrictamente necesario que los estados mentales (...) se realicen en las propiedades físicas de engranajes y máquinas reales. This article deals with how Turing Machine Functionalism turns out to be compatible with a form of Dualism, which involves that strong AI is not close to the original Materialism that inspired it in the nineteenth century. To support this thesis, I argue that there is a compelling coincidence between Descartes' philosophy and this version of Functionalism, since the former holds that it is conceivable/possible to separate mind and body, while the latter holds that it is not strictly necessary that mental states are realized by the physical properties of real cogs and machines. El artículo analiza el papel del resentimiento en la Teoría de los sentimientos morales de Adam Smith y su conexión con el proceso de la simpatía mutua por medio del cual el “espectador imparcial” asume plenamente el resentimiento de la víctima, al considerar que su pasión se rige por los principios de la propiedad y la justicia. Se sostiene que el resentimiento no solo cumple un rol central en la teoría del castigo de Adam Smith, en la medida en que (...) permite retribuir, disuadir y rehabilitar al victimario sino que, además, aporta a la discusión contemporánea sobre el perdón y la reconciliación, pues convoca la posibilidad de superar el resentimiento y restablecer las relaciones sociales entre el agresor y la víctima. El objetivo de este trabajo consiste en analizar dos alternativas presentes en las Disertaciones de Epicteto como posibles vías de acceso a la libertad y la eudaimonía: a) identificar nuestro querer con el querer de la divinidad; b) concentrarnos exclusivamente en aquello de "depende de nosotros". Dado que ambos caminos parecen conducir al solipsismo y la pasividad, ofreceremos una alternativa de interpretación que permite conciliar ambas estrategias con la impronta práctica que caracteriza a la ética del autor. The aim of (...) this paper is to analyse two alternatives which are present in Epictetus' Dissertations as possible ways to reach freedom and happiness: a) to identify our will with the will of the divinity; b) to focus exclusively on "what depends on us". Since both paths seem to lead to solipsism and passiveness, we shall offer an alternative interpretation that can reconcile both strategies with the practical approach of the Epictetus's ethics. In this article, we will analyze the positive dimension of silencing for epistemic practices. Since: silencing refers to a communicative impediment; and at least in part our epistemic agency depends on this ability to express and make ourselves understood, it would be possible to conclude that silencing necessarily harms our epistemic interactions. However, Barrett Emerick reminds us that in some cases silencing helps to preserve the integrity and dignity of those whose epistemic agency is violated. Based on this initial insight, (...) we listed three premises that culminated in the justification for silencing other people: epistemic silences stem from socio-historical processes and the power relations that permeate them; the limits of epistemic agencies are established through social norms and conventions that affect identities in different ways; and, the dignity of the human person must be the criterion for establishing the limits between what should or should not be said. Considering that in order to act correctly it is necessary not only the justifications for acting, but also the appropriate occasion, we defend that practical wisdom is the proper virtue for individuals, groups and institutions to know when to silence other people. Una de las premisas centrales del modelo cognitivista de explicación de las emociones consiste en afirmar que toda emoción es un juicio, afirmación que conduce a lo que denominaré el problema de la restrictividad, es decir, al hecho de que dicho modelo parece impedirnos atribuir emociones a entidades que carecen (temporal o estructuralmente) de la capacidad de juzgar. El objetivo del artículo consistirá en relevar las estrategias a las que recurren los dos autores que han defendido el modelo cognitivista de (...) forma más radical y sostenida (Robert Solomon y Martha Nussbaum) al momento de hacer frente al problema de la restrictividad. Argumentaré, fundamentalmente, que dichas estrategias conducen al modelo cognitivista a un dilema del cual sólo puede salir al precio de perder su especificidad como modelo de explicación de las emociones. This bulletin contains a summary of the main topics of discussion in truthmaker theory, namely: the definition of truthmakers, problems with Truthmaker Necessitarianism and Truthmaker Maximalism, the ontological burden of truthmakers and the recalcitrant topic of truthmakers for negative truths.

Pese a su uso e importancia, no hay investigaciones semánticas sobre los pseudónimos. Aunque resulta claro que los nombres ficticios son importantes en la definición de la identidad de un artista, no ha habido mayor investigación sobre el rol que desempeñan. Aquí, justamente intento mostrar que son fundamentales en el arte, porque permiten crear la identidad de un personaje, pero ello ocurre principalmente en el mundo social. Dada la escasez de investigaciones sobre los pseudónimos y sobre su conexión con la (...) identidad, este artículo muestra: i) que no pueden ser designadores rígidos kripkeanos; ii) que la identidad que conllevan es puramente artística, y no metafísica. En la primera sección, apoyo parte de la propuesta de Kripke acerca de los designadores rígidos: los nombres propios, como tales designadores, deben analizarse a la luz de los mundos posibles; esto es, en términos de cómo podrían haber resultado las cosas de otra manera. En la segunda sección, examino los antecedentes y las consecuencias de que dichos nombres sean designadores rígidos. En la tercera, en cambio, argumento que los pseudónimos no pueden ser designadores rígidos como los nombres propios. Dicha conclusión es alcanzada a partir de la variación de un experimento mental kripkeano, uno que versa sobre Dios y el esfuerzo de Él para crear objetos. En la sección final muestro que los pseudónimos, en vez de designar rígidamente, crean personajes en el mundo social. Por ello la identidad que conllevan no es interna a los objetos; por el contrario, es un tipo de identidad que solo pertenece al mundo social. (shrink)

This article addresses a neglected problem in Searle’s social ontology, namely, how human civilization may collapse. In the first section, I provide the theoretical framework. In the second section, I offer the key elements to understanding Searle’s ontology as well as his philosophy of society, emphasizing the role of constitutive rules and deontic powers. In the third section I examine how they improve trust and co-operation. Global and local natural disasters are distinguished in the fourth section, because the former is (...) sufficient to undermine pacts, promises, constitutive rules and deontic powers, while the latter is neither sufficient nor necessary. In the fifth and final section, I put forward an argument via a thought experiment that allows us to anticipate what would occur if people did not keep promises and pacts, on the one hand, and did not respect constitutive rules and deontic powers, on the other hand. Such events, I argue, would result in the collapse of civilization. (shrink)

El objetivo del trabajo consiste en relevar las funciones asignadas explícitamente por Epicuro a las distintas epítomes que se han conservado de su obra. Dicho relevamiento tendrá por objetivo, en primer lugar, señalar algunas dificultades implícitas en lo que denominaré la Interpretación Mínima, la cual se funda sobre tres presupuestos centrales: i) que el epicureísmo constituye una filosofía accesible a cualquier individuo, sin importar su género, estatus social, linaje o formación filosófica; ii) que, en concordancia con esto, las epítomes epicúreas (...) constituyen resúmenes de las doctrinas principales del epicureísmo que pueden ser leídas por cualquier individuo independientemente de su formación filosófica; iii) que el manejo de las epítomes es suficiente por sí mismo para garantizar el acceso a la eudaimonia. A continuación, analizaré una línea de interpretación alternativa ya sugerida parcialmente por algunos comentaristas, la cual enfatiza la existencia simultánea de dos modalidades de abordaje de las epítomes, para concluir señalando las dificultades inherentes a dicha línea de lectura. John N. Williams argued that Peter Klein's defeasibility theory of knowledge excludes the possibility of one knowing that one has (first-order) a posteriori knowledge. He does that by way of adding a new twist to an objection Klein himself answered more than forty years ago. In this paper I argue that Williams' objection misses its target because of this new twist.

In a recent paper in this journal, David Chalmers introduced the meta-problem of consciousness as “the problem of explaining why we think consciousness poses a hard problem” (Chalmers, 2018, p. 6). A solution to the meta-problem could shed light on the hard problem of consciousness. In particular, it would be relevant to elucidate whether people’s problem intuitions (i.e. intuitions holding that conscious experience cannot be reduced to physical processes) are driven by factors related to the nature of consciousness, or rather (...) by factors that are independent of consciousness. Whether people hold problem intuitions, and what factors drive those intuitions, are largely empirical questions. However, there is a lack of empirical research on these issues to date. The results of four studies will show that (1) problem intuitions are not widespread, and (2) when they arise, they do so because of factors that are unrelated to the nature of consciousness. This suggests that consciousness is, after all, not so problematic. (shrink)

According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

The notion of a correct appreciation of nature, like the one put forward in Carlson’s environmental account, has been rejected by many other authors in the aesthetics of the natural environment. Their critics challenge the idea that only scientific cat- egories can ground the aesthetic appreciation of nature as nature, and they hold that there is not a correct way of appreciating nature. However, they may share with Carlson the idea of correctness under an objectivist paradigm of aesthetic appreciation, according (...) to which correctness means the adequation of the experi- ence to properties of the object. My aim in the article is to claim that it is necessary to endorse an aesthetic standard of correctness that takes into consideration the subjective character of aesthetic appreciation. An aesthetic standard of correct- ness implies universal assent, or validity for everyone in Kantian terms, in place of an objectivist notion. This notion of correctness permits the inclusion of expressive perception of nature as an essential form of aesthetic appreciation. (shrink)

La respuesta que demos a la problemática del nominalismo en la obra de Baruch Spinoza determina en forma decisiva las posibilidades de responder satisfactoriamente a la pregunta por la naturaleza humana. Dictaminar (junto con numerosos intérpretes contemporáneos) que el spinozismo se construye sin concesiones sobre principios nominalistas, implica sustraer todo fundamento ontológico a las consideraciones acerca de la natura humana, piedra de toque de la deducción spinozista de los afectos y de las estrategias terapéuticas que señalan el camino hacia la (...) beatitudo. Nuestra intención, por el contrario, consistirá en señalar el componente necesariamente universal que subyace bajo la psicología spinozista, para lo cual habremos de señalar ciertos aspectos centrales en cuanto a la problemática de los géneros de conocimiento, así como respecto de la teoría spinozista de la definición. Since the automation revolution of our technological era, diverse machines or robots have gradually begun to reconfigure our lives. With this expansion, it seems that those machines are now faced with a new challenge: more autonomous decision-making involving life or death consequences. This paper explores the philosophical possibility of artificial moral agency through the following question: could a machine obtain the cognitive capacities needed to be a moral agent? In this regard, I propose to expose, under a normative-cognitive perspective, the (...) minimum criteria through which we could recognize an artificial entity as a genuine moral entity. Although my proposal should be considered from a reasonable level of abstraction, I will critically analyze and identify how an artificial agent could integrate those cognitive features. Finally, I intend to discuss their limitations or possibilities. (shrink)

En el presente trabajo propongo una interpretación de las Dissertationes de Epicteto estructurada sobre dos argumentos centrales: el Argumento Eudaimonista y el Argumento Teleológico. Sugeriré que a pesar de las estrategias que el autor presenta para evitar la acusación de solipsismo, Epicteto no puede escapar a la misma, y que la figura de la divinidad adquiere, por esa misma razón, una dimensión que ha sido desestimada por los comentaristas contemporáneos. -/- In the present paper I put forward an interpretation of (...) Epictetus Discourses which is based on two main arguments: the Eudaimonistic Argument and the Teleological Argument. I suggest that despite the author's strategies to avoid the accusation of solipsism, Epictetus cannot escape it, and that the figure of the divinity acquires, for this very reason, a dimension that has been overlooked by contemporary critics. Peter Milne has tried to refure Truthmaker Maximalism. the thesis that every truth has a truthmaker, by producing a simple and direct counterexample to it, the sentence M: This sentence has no truthmaker. I argue that, contrary to what Milne argues, on Truthmaker Maximalism M is equivalent to the Liar, which gives the truthmaker maximalist a way to defend his position from Milne's counterexample: to argue that M expresses no proposition.

Evaluative judgments imply positive or negative regard. But there are different ways in which something can be positive or negative. How do we tell them apart? According to Evaluative Sentimentalism, different evaluations (e.g., dangerousness vs. offensiveness) are grounded on different emotions (e.g., fear vs. anger). If this is the case, evaluation differentiation requires emotional awareness. Here, we test this hypothesis by looking at alexithymia, a deficit in emotional awareness consisting of problems identifying, describing, and thinking about emotions. The results of (...) Study 1 suggest that high alexithymia is not only related to problems distinguishing emotions, but also to problems distinguishing evaluations. Study 2 replicated this latter effect after controlling for individual differences in attentional impulsiveness and reflective reasoning, and found that reasoning makes an independent contribution to evaluation differentiation. These results suggest that emotional sensibilities play an irreducible role in evaluative judgment while affording a role for reasoning. (shrink)

In this chapter I shall reply to a pair of articles in which the main contention of my “Why truthmakers” – namely, that an important class of synthetic true propositions have entities as truth-makers – is rejected. In §§1–5 I reply to Jennifer Hornsby’s “Truth without Truthmaking Entities” (2005) and in §§6–7 I reply to Julian Dodd’s “Negative Truths and Truthmaker Principles” (2007).

It is generally assumed that emotion concepts are purely descriptive. However, recent investigations suggest that the concept of happiness includes information about the morality of the agent's life. In this study, we argue that normative influences on emotion concepts are not restricted to happiness and are not about moral norms. In a series of studies, we show that emotion attribution is influenced by whether the agent's psychological and bodily states fit the situation in which they are experienced. People consider that (...) emotions are not just about feeling in certain ways, but also about feeling the right way. (shrink)

The goal of this paper is to suggest that theoretical thinking with respect to metaphysical determinations or indeterminations is not the appropriate realm for attributing moral responsibility. On the contrary, judgments that attribute moral responsibility (S is responsible for...) depend on the possibility that a rational narrative be built. Agents are capable of forging their future actions, as well as of reflecting upon past actions. With this it will also be shown how we assume control of our behavior because we (...) ignore whether actions are the result of causality or chance. It is claimed that contexts determine the degree of causal demand in narratives that attribute moral responsibility. In order to construct this type of narrative one must focus on a specific link in the causal chain of explanations. If context alone is not demanding enough so as to require that theoretical reflections strive for the ultimate foundation of our actions, then the agent may be considered responsible for his behavior. This paper argues that a necessary condition on inferential knowledge is that one knows all the propositions that knowledge depends on. That is, I will argue in support of a principle I call the Knowledge from Knowledge principle: (KFK) S knows that p via inference or reasoning only if S knows all the propositions on which p depends. KFK meshes well with the natural idea that (at least with respect to deductively valid or induc- tively strong arguments) the epistemic status (...) of one’s belief in the conclusion of an argument is a function of the epistemic status of the attitudes one has to the premises of that argument. One gets what one puts in: S’s belief in the conclusion C of an argument A has epistemic status E for S only if S’s belief in each of the premises C depends on also has epistemic status E.1 This is compatible, of course, with the epistemic status of S’s conclusion being greater than the epistemic status of the premises on which the conclusion of her reasoning depends. Furthermore, even though KFK applies more straightforwardly to non-suppositional inferences, we can also plausibly apply the principle to sup- positional reasoning if we treat S’s assuming for the sake of argument that p,2 as S assuming for the sake of argument that she knows that p.3 Although extremely plausible, philosophers have failed to present a concerted case in support of KFK. Most of their energy goes to articulating and/or defending some form of closure principle for knowledge.4 What is more, recently versions of this principle have been dismissed as problematic but I think without the reasons in its support been fully appreciated. This paper is an e fort to change the current state of affairs. Its focus is positive, however: my goal is to make the best case I can in support of KFK.5 To that end, the paper presents the reasons we have to accept KFK (§1), consid- ers an objection to the principle (§2), and situates the principle in the broader normative context of knowledge norms (§3). My main aim at this paper is to present Lewis Carrol’s Paradox on the justification of logical principles inasmuch as some attempts of solving it. This is important because if there are basic logical principles, it also seems necessary to exist some justification for them. By considering some observations from Ryle, Devitt and Kripke about the theme, we intend to briefly display their theories and their core critics among themselves and, mainly, the critics against adoption theory.

The paper argues that grounding is neither irreflexive, nor asymmetric, nor transitive. In arguing for that conclusion the paper also arguesthat truthmaking is neither irreflexive, nor asymmetric, nor transitive.

In this paper I consider recent discussions within the representationalist theories of phenomenal consciousness, in particular, the discussions between first order representationalism (FOR) and higher order representationalism (HOR). I aim to show that either there is only a terminological dispute between them or, if the discussion is not simply terminological, then HOR is based on a misunderstanding of the phenomena that a theory of phenomenal consciousness should explain. First, I argue that we can defend first order representationalism from Carruthers' attacks (...) and ignore higher order thoughts in our account of phenomenal consciousness. Then I offer a diagnostic of Carruthers' misunderstanding. In the last section I consider further reasons to include mindreading abilities in an explanation of phenomenal consciousness. (shrink)

En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga.
